It is a practical issue because it can significantly affect how much money you actually keep after the sale.<\/p>\n<p data-start=\"366\" data-end=\"585\">In Italy, however, not every gain is taxed: taxation applies only under specific conditions (typically: sale within 5 years, subject to exceptions), and with calculation rules that are very much <strong data-start=\"561\" data-end=\"584\">documentation-based<\/strong>.<\/p>\n<p data-start=\"587\" data-end=\"820\"><strong data-start=\"587\" data-end=\"596\">Note:<\/strong> this article is for informational purposes only. For specific cases (gifts, inheritances, Superbonus, co-ownership, exchanges, rent-to-buy, etc.), it is always advisable to check with a notary or tax advisor before signing.<\/p>\n<hr data-start=\"822\" data-end=\"825\" \/>\n<h2 data-start=\"827\" data-end=\"903\">1) When the capital gain is taxable: the 5-year rule (and the exceptions)<\/h2>\n<p data-start=\"905\" data-end=\"1067\">For buildings (residential and non-residential) and non-buildable land, the capital gain is generally taxable only if <strong data-start=\"1023\" data-end=\"1030\">all<\/strong> of the following conditions are met:<\/p>\n<ol data-start=\"1069\" data-end=\"1359\">\n<li data-start=\"1069\" data-end=\"1162\">\n<p data-start=\"1072\" data-end=\"1162\">you purchased (or built) the property for consideration (or received it by way of a gift);<\/p>\n<\/li>\n<li data-start=\"1163\" data-end=\"1222\">\n<p data-start=\"1166\" data-end=\"1222\">you resell it within 5 years from purchase\/construction;<\/p>\n<\/li>\n<li data-start=\"1223\" data-end=\"1359\">\n<p data-start=\"1226\" data-end=\"1359\">it was <strong data-start=\"1233\" data-end=\"1240\">not<\/strong> used as your main residence (or that of your family members) for the majority of the period between purchase and sale.<\/p>\n<\/li>\n<\/ol>\n<h3 data-start=\"1361\" data-end=\"1437\">Typical cases where capital gains tax is <strong data-start=\"1406\" data-end=\"1413\">NOT<\/strong> due (or is not taxable)<\/h3>\n<ul data-start=\"1439\" data-end=\"1849\">\n<li data-start=\"1439\" data-end=\"1529\">\n<p data-start=\"1441\" data-end=\"1529\">Sale after 5 years from purchase\/construction (note: different rule for buildable land).<\/p>\n<\/li>\n<li data-start=\"1530\" data-end=\"1623\">\n<p data-start=\"1532\" data-end=\"1623\">Property acquired by inheritance: the capital gain is excluded even if sold within 5 years.<\/p>\n<\/li>\n<li data-start=\"1624\" data-end=\"1710\">\n<p data-start=\"1626\" data-end=\"1710\">Property used as the main residence (yours or your family\u2019s) for most of the period.<\/p>\n<\/li>\n<li data-start=\"1711\" data-end=\"1849\">\n<p data-start=\"1713\" data-end=\"1849\">Property received as a gift: to verify the 5-year period, one often looks at the donor\u2019s purchase date (a very relevant practical rule).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1851\" data-end=\"2062\"><strong data-start=\"1851\" data-end=\"1865\">Important:<\/strong> taxation does not depend on speculative intent or on having purchased with \u201cfirst-home\u201d benefits. What matters are the objective requirements (five-year period, main residence, inheritance, etc.).<\/p>\n<hr data-start=\"2064\" data-end=\"2067\" \/>\n<h2 data-start=\"2069\" data-end=\"2107\">2) Buildable land: a separate world<\/h2>\n<p data-start=\"2109\" data-end=\"2266\">Capital gains from the sale of buildable land (land \u201ccapable of building use\u201d) are <strong data-start=\"2192\" data-end=\"2210\">always taxable<\/strong>, even if you have owned the land for more than 5 years.<\/p>\n<p data-start=\"2268\" data-end=\"2445\">This is a technical area (urban planning classification, zoning instruments, certificates), so it is advisable to prepare the file with a professional before accepting an offer.<\/p>\n<hr data-start=\"2447\" data-end=\"2450\" \/>\n<h2 data-start=\"2452\" data-end=\"2535\">3) How the capital gain is calculated: the \u201csimple\u201d (but document-based) formula<\/h2>\n<p data-start=\"2537\" data-end=\"2555\">The basic rule is:<\/p>\n<p data-start=\"2557\" data-end=\"2637\"><strong data-start=\"2557\" data-end=\"2637\">Capital gain = Sale price \u2013 (Purchase\/build cost + documented related costs)<\/strong><\/p>\n<h3 data-start=\"2639\" data-end=\"2678\">What counts as \u201ccost\u201d (in practice)<\/h3>\n<ul data-start=\"2680\" data-end=\"2968\">\n<li data-start=\"2680\" data-end=\"2720\">\n<p data-start=\"2682\" data-end=\"2720\">purchase price (or construction cost);<\/p>\n<\/li>\n<li data-start=\"2721\" data-end=\"2826\">\n<p data-start=\"2723\" data-end=\"2826\">taxes and charges related to the purchase (often considered \u201crelated\u201d if connected to the acquisition);<\/p>\n<\/li>\n<li data-start=\"2827\" data-end=\"2968\">\n<p data-start=\"2829\" data-end=\"2968\">documented value-increasing expenses: for example, works that increase value, technical fees, urbanization charges, subdivision costs, etc.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2970\" data-end=\"3119\">\ud83d\udc49 The key point is <strong data-start=\"2990\" data-end=\"3006\">\u201cdocumented\u201d<\/strong>: without invoices, bank transfers, or deeds, that cost often cannot be included, and the taxable gain increases.<\/p>\n<h3 data-start=\"3121\" data-end=\"3184\">\u201cPrice-value\u201d system and capital gains: beware of confusion<\/h3>\n<p data-start=\"3186\" data-end=\"3401\">The \u201cprice-value\u201d mechanism applies to indirect taxes (registration tax) on certain transactions, but capital gains are calculated on the <strong data-start=\"3324\" data-end=\"3345\">actual sale price<\/strong>. Confusing the two is a common mistake in negotiations.<\/p>\n<hr data-start=\"3403\" data-end=\"3406\" \/>\n<h2 data-start=\"3408\" data-end=\"3471\">4) How the tax is paid: ordinary IRPEF or 26% substitute tax<\/h2>\n<p data-start=\"3473\" data-end=\"3528\">When the capital gain is taxable, you have two options:<\/p>\n<h3 data-start=\"3530\" data-end=\"3559\">Ordinary taxation (IRPEF)<\/h3>\n<p data-start=\"3560\" data-end=\"3657\">The gain is declared and added to other income, potentially pushing you into higher tax brackets.<\/p>\n<h3 data-start=\"3659\" data-end=\"3688\">26% substitute tax (flat)<\/h3>\n<p data-start=\"3689\" data-end=\"3759\">You may opt to pay a 26% substitute tax directly at the notarial deed.<\/p>\n<p data-start=\"3761\" data-end=\"3991\"><strong data-start=\"3761\" data-end=\"3786\">Key operational rule:<\/strong> the option for the substitute tax must be exercised <strong data-start=\"3839\" data-end=\"3861\">in the deed itself<\/strong>. If you do not choose it at completion, you cannot opt for it later; you will be subject to ordinary taxation in your tax return.<\/p>\n<hr data-start=\"3993\" data-end=\"3996\" \/>\n<h2 data-start=\"3998\" data-end=\"4092\">5) Focus 2024+: the \u201cnew\u201d capital gain on properties with Superbonus (sale within 10 years)<\/h2>\n<p data-start=\"4094\" data-end=\"4400\">As of January 1, 2024, a specific regime applies to certain sales of properties on which Superbonus-incentivized works were carried out, if the sale occurs within 10 years from completion of the works (with several exclusions and debated cases). This area is technical and still evolving in interpretation.<\/p>\n<p data-start=\"4402\" data-end=\"4621\">Why does it matter? Because it can completely change the convenience of selling shortly after major refurbishment, especially for properties that are not main residences or have \u201cmixed\u201d origins (inheritance plus works).<\/p>\n<hr data-start=\"4623\" data-end=\"4626\" \/>\n<h2 data-start=\"4628\" data-end=\"4711\">6) \u201cRelated costs\u201d that reduce the capital gain: what is allowed and what is not<\/h2>\n<p data-start=\"4713\" data-end=\"4936\">One of the most delicate aspects in calculating real-estate capital gains is determining which costs are fiscally relevant\u2014i.e., those that can be added to the purchase cost to reduce (sometimes eliminate) the taxable gain.<\/p>\n<p data-start=\"4938\" data-end=\"5098\">The general rule is clear:<br data-start=\"4964\" data-end=\"4967\" \/>\ud83d\udc49 <strong data-start=\"4970\" data-end=\"5098\">only costs directly related to the purchase or that increased the property\u2019s value, and that are documented, are
